Nothing Here Is Professional Advice

The content on this Website — including articles, blog posts, webinars, guides, downloadable materials, calculators, and pricing information — is general information published for educational purposes. It is not accounting, tax, financial, investment, or legal advice, and it is not a substitute for advice from a professional who knows your circumstances.

Tax law changes, and the treatment of any item depends on facts specific to you. Do not act, or refrain from acting, on the basis of anything on this Website without obtaining advice that addresses your own situation.

No CPA-Client Relationship

Using the Website does not make you our client. Submitting a contact form, requesting a consultation, filling in a referral form, subscribing to our newsletter, attending a webinar, sending us an email, or exchanging text messages with us does not create a CPA-client relationship and does not obligate us to act for you.

A professional relationship begins only when both parties have signed an engagement agreement that describes the services to be provided. Until then, please do not send us confidential information you would not want disclosed, and understand that we may be unable to act for you if doing so would conflict with an existing client's interests.

Permitted Use

You may use the Website for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Impersonate Custom Accounting, our personnel, or any other person or entity, or misrepresent your identity or affiliation

SMS Terms

Program Description

Custom Accounting CPA sends SMS text messages regarding appointment scheduling and reminders, tax filing deadlines, document requests, secure client portal notifications, billing and payment notifications, and responses to your inquiries. This is a conversational and service-notification program. It is not a marketing program.

Types of Messages

If you opt in, you consent to receive text messages regarding:

  • Appointment scheduling and appointment reminders
  • Tax filing deadlines
  • Document requests
  • Secure client portal notifications
  • Billing and payment notifications
  • Responses to your inquiries and customer support
  • Other service-related communications

Eligibility

You must be at least 18 years of age, or the age of majority where you live, to consent to receive text messages from us.

How Consent Is Obtained

We send text messages only to mobile numbers for which we have express written consent. You can give consent by checking the text message consent box on our website contact, consultation, referral, or intake forms; by giving us your mobile number and marking your consent in a signed engagement agreement or onboarding document; or by texting our business number. The consent box is never pre-checked, you can submit the form without checking it, and consent is never bundled with acceptance of any other agreement.

Opt-Out

Reply STOP to any message at any time to opt out. We will send one confirmation and no further text messages to that number unless you opt in again. To resubscribe, reply START or contact us. Opting out of text messages does not affect email or telephone contact about your account, and it does not end any engagement agreement.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Consent to receive SMS messages is not a condition of purchase or of engaging our services.

Non-Sharing of Opt-In Data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services.

Sensitive Documents

Text message is not a secure channel. Please send tax documents and financial records through our client portal rather than by text.

Intellectual Property

The Website and its contents — including text, graphics, logos, images, layout, data, and software — are the property of Custom Accounting CPA or its licensors and are protected by copyright, trademark, and other intellectual property laws. Custom Accounting CPA and our logo are our marks and may not be used without our written permission.

You may view and print pages of the Website for your own reference. You may not otherwise reproduce, republish, distribute, modify, or create derivative works from any part of it without our prior written permission.

Reporting Intellectual Property Infringement

Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.

YOU AND CUSTOM ACCOUNTING CPA EACH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

General

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Website, and replace any earlier version. They do not supersede a signed engagement agreement, which controls the services described in it.

Changes to These Terms

We may update these Terms. When we do, we will change the effective date at the top and post the updated version on this page. Changes take effect when posted. Continuing to use the Website after that means you accept the updated Terms.
